These Terms of Use ("Terms") govern your access to and use of Madison Social Club's website, membership, facilities, and related services ("Services"). By submitting an application, paying membership fees, or using our Services, you agree to these Terms.
Membership and Eligibility
Membership is subject to approval by the Club. By applying, you represent that the information you provide is accurate and complete. The Club reserves the right to accept or decline any application at its sole discretion. Membership is personal and non-transferable unless otherwise agreed in writing (e.g., for designated couple or family tiers).
Fees and Billing
Membership fees are recurring and will be charged in accordance with the tier and billing cycle you select (e.g., monthly or annually). You authorize the Club and its payment processors to charge the payment method on file for all applicable fees, including initiation fees, dues, and any other charges you incur. Fees are non-refundable except as required by law or as otherwise stated in a separate agreement. The Club may change fee amounts with reasonable notice to members.
Cancellation and Termination
You may cancel your membership in accordance with the cancellation policy provided at the time of enrollment or in your membership agreement. The Club may suspend or terminate your membership for breach of these Terms, failure to pay fees, or conduct that the Club determines is harmful to the Club or other members. Upon termination, your right to use the facilities and Services ceases, and no refund of prepaid fees will be made unless otherwise required by law or your membership terms.
Conduct and Use of Facilities
Members and guests must conduct themselves in a manner consistent with the Club's standards and applicable law. The Club may establish house rules, dress codes, and policies for use of the premises. You are responsible for your own conduct and that of any guests you bring. The Club reserves the right to refuse entry or remove any person whose behavior it deems inappropriate.
Website and Communications
Use of our website is subject to these Terms and our Privacy Policy. You may not use the website or our systems to transmit harmful, offensive, or illegal content, or to interfere with the operation of the Club or other members. We may send you communications related to your membership and Club activities; you may opt out of non-essential marketing where permitted by law.
Disclaimer of Warranties
The Club and its Services are provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Club, facilities, and Services. We do not guarantee uninterrupted access or that the Club will meet any particular standard beyond what is expressly agreed in your membership terms.
Limitation of Liability
To the maximum extent permitted by law, the Club and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, or consequential damages arising from your membership or use of the Services. Our total liability shall not exceed the amount of fees you paid to the Club in the twelve (12) months preceding the claim.
Changes to Terms
We may modify these Terms at any time. Material changes will be communicated to members via email or other reasonable means. Continued use of the Club or Services after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must cancel your membership in accordance with the cancellation policy.
General
These Terms, together with the Privacy Policy and any membership or house rules, constitute the entire agreement between you and Madison Social Club. Any waiver of a provision must be in writing. If any provision is held invalid, the remaining provisions remain in effect. These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
